I think 78s are one typer, issues derived from tape another, and those which
are digital yet another- matters of generation.

Questions of editing and edited versions are another problem.  Anyone
remember the Szell Dvorak Dances, issued first in AABA form as intended,
later put onto a single record with the first repeat removed?  This becomes
even more important with pop stuff.  Smith's "Baby, It's You," in the same
AABA form as the Dvorak on LP, lacks the second verse on the 45 hit.

Furthermore, the matter of intent arises:  When it was recorded, was it done
with intent of comercial release?  If it is a radio braodcast, that's
another issue.  And private recordings, those falling under common-law
copyright, are yet another.  And if it's a rehearsal, not intended to be
heard by the public, is issuing it an invasion of privacy? (I almost wrote
piracy)

What this adds up to is a series of situations with legal implications.

Does "unpublished" with a note expaning on this cover it sufficently?

Do we want to spend a lot of email time on this subject?
