True HOWEVER ALMOST NOBODY PAYS STATUTORY ROYALTY RATES.
	
SoundExchange has TOTAL authority to negotiate royalties on behalf of its
members that are BELOW the statutory rate. That's what they do, the whole
point of the organization. They are in the process of negotiating actual
webcasting royalties right now.

SoundExchange ALSO  represents artist's and copyrights owners' interests in
negotiating the statutory rate  which additionally applies to folks who are
not members of SoundExchange. This is the only rate that is supervised by a
government panel. The statutory rate and the procedure for setting it were
first proposed and then created as a result of lobbying by the internet,
telecom and personal computing industries. There has been no further change
in the new rate because nobody could convince an appeals court or the
Congress that the rate setting process had been unfair or that there was any
other reason for such a change.

The statutory rate and the rate most people will actually pay have always
been two completely different issues.

Their only relationship is the fact that artists and sound copyright owners
can't negotiate for anything greater than the statutory rate no matter how
much a webcaster may be earning.
