Lessig's article is interesting. Thanks for the link. Some of what he is proposing will never be OK with large companies whose profitability is based on zealous protection of copyright, but there is a middle ground. Viacom is closer to the middle ground than Universal. Also, as is typical with these kinds of debates, he cited extreme and simplistic cases in the WSJ article. There's not a cut and dried place to say something is obviously not a threat to copyright even though it contains snippets of copyrighted material, but such cases obviously do exist. The net-net is muddy gray area. Some modern law updates by Congress and clear case-law precidents would be helpful.
